Terms of Use Legal Notes and General Conditions of the Contract
1. Scope and object of the contract. 1.1. These General Conditions of Contract govern the relationship between Lakes and Mountains Magic Holiday House (hereinafter LM) and the Customer in relation to the provision of accommodation Services chosen by the Customer in the booking proposal made from those offered by the Facility, viewable on the website xxxxxxx or on the website xxxxxxx. 1.2. The request for provision of the Services can be made by the Customer by submitting the Booking Proposal to LM by: sending an email to the email address lakesmountainsmagic@gmail.com; by telephone, verbally, by contacting the number +39 3494453807; by means of the online booking procedure on the website. 1.3. The contract is considered concluded when the Customer formulates the Booking Proposal in the manner set out in point 1.2. and brings it to the attention of LM. The actual conclusion is always subject to the availability of the Service. This confirmation is provided by LM at the same time as receiving the proposal or immediately thereafter. 1.4. If the activation of the Services cannot take place due to impediments not attributable to LM, the contract will be automatically terminated, without this entailing any type of liability of LM towards the Customer. 2. Activation and provision of the Service 2.1. Upon activation of the Service, LM guarantees the Customer: – the enjoyment of furnished housing units (hereinafter “Apartment”), in the number and type defined in the Proposal; internet connection, weekly tidying and change of linen, and any service provided for by the current regional law on holiday homes. 2.2. LM deliveries will be on loan for use to the Customer any other accessory equipment aimed at the complete use of the chosen Services (keys, cards, etc.). 2.3. The Customer must use the apartment, common areas and equipment in such a way as not to disturb the normal performance of the Service and third parties staying in the holiday home facilities. The Customer will be exclusively liable for any direct damages resulting from the violation of this obligation, holding LM harmless from any consequence, cost or charge. 2.4. The Customer will hold LM harmless from any prejudice, damage, liability, expenses, including legal expenses, suffered or incurred by LM, and will also indemnify it from any action, reason, claim made by third parties against it that find cause or reason in behaviors and/or omissions in any way attributable to the Customer himself or are in any case a consequence of non-compliance and/or violation of the precepts set forth in these General Contract Conditions . 3. Booking and Payment. 3.1. In the case of Booking for a future period, LM may request the Customer to pay the amount due in advance. 3.2. Failure to pay the amount due within the established terms will result in the cancellation of the reservation, without the need for any communication from LM. 3.3 In the event of cancellation of the stay within 15 days prior to arrival, 50% of the amount due will be refunded, deducted from bank commissions in the case of bank transfer. 3.4 In the event of cancellation of the stay 15 days prior to arrival or in the event of a no-show, no refund will be made 3.5 In the event of late arrivals or early departures, the full cost of the stay will be charged 4. Duration of the contract, cancellations and penalties. 4.1. The Contract is valid and effective from the date of conclusion of the Contract itself and ends if both of the following conditions are satisfied: – the Client and third parties connected to it, or dependent on it, have definitively left the Accommodation Facility; – the Client has paid the entire amount due to LM. 4.2. Check-in can be done between 15.00 and 00.00, there is no possibility of using the entire structure before this time. Any arrivals outside of these hours must be agreed in advance with LM. Failure to give notice may cause problems not attributable to LM. It is also possible to enter the structure independently, therefore even after the scheduled check-in time, but never before 15.00. For independent entry, the Customer must agree with LM. Check-out must take place strictly by 10:00, if this does not happen the cost of an additional night will be charged. 4.3. the Customer has the right to cancel the reservation and terminate the contract within the terms of the times indicated in point 3.1. No refund is provided for the guest who leaves LM early, whatever the reason.
5. Protection of privacy.
5.1. The Customer is informed, pursuant to Article 13 of Legislative Decree no. 196/2003, that the processing of personal data provided to LM is necessary in order to allow the B&B directly or through third parties to fulfill the obligations arising from this contract or for the fulfillment of the obligations provided for by the Law or regulations. 5.2. The data controller is the legal representative of LM. 6. Documents. 6.1. Upon arrival, valid identity documents (Passport, Identity Card) must be handed over, necessary for the registrations required by current legislation. Failure to comply with this obligation constitutes a violation of the provisions of the penal code and authorizes us to request immediate abandonment of the facility. Our guests' data are processed in accordance with current privacy legislation. 7. Responsibility 7.1. LM will be responsible for the breach of contract and the provision of the Service exclusively for acts attributable to It. 7.2. If the Customer upon arrival finds a Service different from the one agreed but accepts it anyway, it is automatically considered to have forfeited any claim for compensation and the new Service replaces, by agreement of the parties, the one previously agreed. 8. Limits of liability. 8.1. LM will not be responsible in the event of delays, inconveniences, malfunctions and/or interruptions of the Service due to: – unforeseeable circumstances or force majeure; – tampering or interventions on the service or equipment carried out by the Customer or by third parties not authorised by LM; – damage or inconvenience caused by the total or partial interruption of the supply of electricity or water; – LM will not be responsible for valuables owned by customers and brought into the facility. 9. The recommended management: 9.1. Silence/Children. Total silence must be observed from 11:00 pm to 8:00 am and from 2:00 pm to 4:00 pm both in the rooms and in the common areas, including the stairwell; Children must always be accompanied by an adult. In any case, a behavior must be maintained that at no time of the day and in no way disturbs the tranquility of others. 9.2. Other Guests. It is strictly forbidden to bring other people into the house, on the terrace and in any area without the authorization of the manager, under penalty of a supplement of € 250.00. The customer may not sublet or lend, in whole or in part, the house, under penalty of termination of the reservation right and a penalty supplement of € 250.00. 9.3. Breakfast. The property does not provide breakfast service as it is a holiday home. However, inside each apartment the guest will find an equipped kitchen. 9.4. Smoking / Weapons / Drugs. It is strictly forbidden to bring in weapons, narcotics and other substances. The contract will be immediately terminated. It is also strictly forbidden to smoke in the house. You can smoke freely on the terrace, strictly using the ashtrays present there. 9.5. Personal Objects. You cannot leave objects of any kind in the corridors or in the common areas. LM is not responsible for personal objects left unattended. LM declines all responsibility for the loss, theft or damage of objects of your property left unattended in the houses. 9.6 Sense of modesty It is strictly forbidden to wander around the structure wearing clothing that may offend the modesty of others. In any case, the Customer is forbidden to carry out acts, and behave in ways, that may disturb the other inhabitants of the building. 9.7. Toilets. We recommend correct and civil use of the toilets, avoiding throwing anything in the toilet (use the appropriate bins). 10. Pets 10.1Pets are welcome, a supplement of €8.00 per pet per night is required for additional cleaning. 10.2 Owners are responsible for their pets and respect the house rules, such as not leaving the pet alone and unattended in the apartment.
